These Terms of Service govern your use of the Webalert website uptime monitoring and status page service available at web-alert.io. By creating an account or using the Service, you agree to be bound by these Terms.

The Service is primarily intended for business customers (B2B). By using Webalert, you confirm that you have the authority to accept these Terms on behalf of the customer entity, and that you are using the Service for business or professional purposes.
2. Acceptance of Terms
By accessing or using Webalert ("the Service"), you accept and agree to be bound by these Terms. If you do not agree to the Terms, you must not use the Service.
When you create an account, you may be asked to confirm your acceptance of these Terms (for example by checking a box). Such confirmation and your continued use of the Service constitute acceptance of the Terms.
3. Description of Service
Webalert provides website monitoring and uptime tracking services. The Service allows you to configure monitors for your websites or services, receive alerts when they are unavailable or degraded, and publish public status pages.
We may improve, modify, or change features of the Service over time. We may also suspend or discontinue the Service or parts of it where necessary, for example for maintenance, security, or legal reasons. Where reasonably possible, we will give you prior notice of material changes.
4. User accounts and responsibilities
To use certain features of the Service, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account password.
- All activities that occur under your account.
- Notifying us immediately of any unauthorised use of your account or other security incident.
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
5. Acceptable use
You agree not to use the Service to:
- Monitor websites or systems you do not own or have permission to monitor.
- Send spam or unsolicited communications.
- Violate any applicable laws or regulations.
- Interfere with or disrupt the Service or servers.
- Attempt to gain unauthorised access to any portion of the Service.
- Use the Service for any fraudulent, abusive, or malicious activity.
You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations, including data protection and marketing rules relevant to your business and your own customers.
6. Plans, billing, and payment
Webalert offers a free plan and paid subscription plans as described on our pricing page. Paid plans are typically billed monthly in advance via our payment provider, Stripe, using the payment method you provide.
By entering your payment details, you authorise us and our payment provider to charge the applicable subscription fees and any applicable taxes to your payment method on a recurring basis until you cancel. Prices and plan details may change over time; any changes will be communicated in advance where required.
Unless stated otherwise, prices shown on our website are exclusive of value added tax (VAT) and similar indirect taxes. Where required by law, applicable VAT will be added at checkout based on your billing details.
You can cancel your subscription at any time via your account. Upon cancellation, you will continue to have access to the paid features until the end of your current billing period. Fees already paid are non-refundable except where required by law or where we explicitly offer a guarantee.
We currently offer a 14-day money-back guarantee for first-time subscriptions. If you are not satisfied, you can contact us at contact@web-alert.io within 14 days of your initial payment to request a refund.
7. Service availability
While we strive to provide high uptime for our monitoring service, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
8. Data protection and privacy
We take your privacy seriously. Your use of the Service is also governed by our Privacy Policy, which explains in more detail how we collect and process personal data in compliance with GDPR and applicable Danish data protection law.
In short:
- We process account and billing data as data controller to provide and manage your subscription.
- To the extent we process personal data on your behalf (for example in monitoring logs), we act as your data processor and will process such data only to provide the Service, subject to appropriate data processing terms.
- You retain all rights to your data. You can export or delete your data at any time through your account settings, subject to legal retention requirements.
9. Intellectual property
The Service, including all content, features, and functionality, is owned by Webalert and is protected by international copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our Service without our explicit written permission.
10. Warranties and limitation of liability
The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be error-free or uninterrupted, or that it will meet your specific requirements.
To the maximum extent permitted by applicable law, Webalert shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses arising out of or in connection with your use of the Service.
Our total aggregate liability for any claims under these Terms shall not exceed the amount you have paid us for the Service in the twelve (12) months immediately preceding the event giving rise to the claim.
11. Term and termination
These Terms apply for as long as you have an account or otherwise use the Service. Either party may terminate the agreement at any time in accordance with this section.
You may terminate your account at any time via your account settings. We may suspend or terminate your account if you materially breach these Terms, use the Service in a way that creates risk to us or to others, or if we are required to do so by law.
Upon termination, your right to use the Service will immediately cease, and we may delete your account and data after a reasonable period, subject to any legal retention obligations.
12. Changes to these Terms
We may update these Terms from time to time. We will notify you of any material changes by email or through the Service. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
13. Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them, or their subject matter or formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions.
The courts of Denmark shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter.
